As you use our Service, we collect information to analyze how the Service is used, diagnose service or technical problems, maintain security, personalize content, provide you with updates about the Service, remember information to help you efficiently access your account, help you connect with others on the Service, monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns, and track user Content and users as necessary to comply with the Digital Millennium Copyright Act and other applicable laws. We do not sell your personal data such as your name and contact information to third parties to use for their own marketing purposes.
When you sign up for DeciZone and register a member account via the Service, you provide us information about yourself. This information may include your name, email address, profile photo, phone number, physical address and other information. If you sign up for the Service on behalf of a business entity, we may ask you for information about your business. When you register with us, your name and any other information you select will be added to your public profile, which will be available for public viewing on the Service. You can reduce the risk of being personally identified by using the Service pseudonymously, though doing so could detract from the credibility of your content contributions to the Service.
You may also choose to provide us with your mobile phone number if you wish to submit or discover Content via text message when we offer that feature. We may use your email address to send you Service-related notices (including any notices required by law, in lieu of communication by postal mail). You can control receipt of certain Service-related messages on your Settings page. We may also use your contact information to send you marketing email messages. If you do not want to receive such marketing messages, you may opt out by following the instructions in the message or on the account preferences page.
If you use your Facebook, Twitter, or other social networking site ("SNS") account information to sign in to the Service, we will collect and store your SNS user ID. If you connect your DeciZone account with your SNS account (such as to enable posting from DeciZone), we ask for your consent to collect certain information from your SNS account (such as information from your SNS profile, your contacts, and other information).
If you correspond with us by email, we may retain the content of your email messages, your email address, and the communications.
You also provide us information in the Content you post to the Service. Your questions, flowcharts, comments, ratings, and other contributions on the Service, and metadata about them (such as when you posted them), may be publicly viewable on the Service, along with your name, unless you explicitly mark your Content as private. This information may be searched by search engines and may be re-published elsewhere on the internet in accordance with our Terms.
In addition, answers to decision questions within flowcharts may contain personal information, either on their own or in combination with other answers. By filling out a flowchart input text box you agree to provide us with such personal information and permit us to forward such personal information to the person, database or email address set up to receive such emails for that flowchart.

When you use the Service, we may use persistent and session cookies and other tracking technologies to: (a) store your username and password for your convenience and security; (b) analyze usage and Content to improve the Service; (c) customize the Service to your preferences and Content to make your experience more enjoyable; and (d) control the advertising displayed by the Service to make the advertising more relevant to you.
A persistent cookie remains on your computer after you close your browser so that it can be used by your browser on subsequent visits to the Service. This allows us to improve your login process by remembering your username and/or password if you request that we remember that information. If you wish to remove persistent cookies, please visit the settings of your web browser. A session cookie is temporary and disappears after you close your browser. You can reset your web browser or device to refuse all cookies or to indicate when a cookie is being sent.
We use first party and third party cookies for several reasons. Some cookies are required for technical reasons in order for our Websites and/or App and/or platform to operate, and we refer to these as "essential" or "strictly necessary" cookies. Because these cookies are strictly necessary to deliver the Websites and the Services to you, you cannot refuse them.
Other cookies also enable us to track and target the interests of our users to enhance the experience on our Websites and/or App and/or platform. Third parties serve cookies through our Websites and/or App and/or platform for analytics and other purposes.
We and our third party partners may use other, similar technologies from time to time, like web beacons, pixels (or “clear gifs”) and other tracking technologies. These are tiny graphics files that contain a unique identifier that enable us to recognize when someone has visited our Websites or, in the case of web beacons, opened an e-mail that we have sent them. This allows us, for example, to monitor the traffic patterns of users from one page within our Websites to another, to deliver or communicate with cookies, to understand whether you have come to our Websites from an online advertisement displayed on a third-party website, to serve targeted advertisements to you and others like you, to improve site performance, and to measure the success of marketing campaigns. While you may not have the ability to specifically reject or disable these tracking technologies, in many instances, these technologies are reliant on cookies to function properly; accordingly, in those instances, declining cookies will impair functioning of these technologies.
To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements.
To prosecute and defend a court, arbitration, or similar legal proceeding.
To respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.
To carry out other legitimate business purposes, as well as other lawful purposes about which we will notify you.
Please note that some communications (such as service messages, account notifications, billing information) are considered transactional and necessary for account management, and you cannot opt out of these messages unless you delete/close your DeciZone account.
Only our personnel, service providers and trusted third-party applications have access to your Personal Data. These parties include hosting, back-up and other IT services providers, website analytics companies, providers of digital advertising services, providers of CRM, marketing and sales software solutions, billing and processing payments functions. We only provide such parties with the information that they need to perform the services we have hired them to provide.
With Your Consent, we may share Personal Data about you with third parties. For example, with your permission we may publish and display your personal information in testimonials, leaderboards, top-rated items, recent items or featured customer stories on our Websites, including names and profile photo of representatives of our customers alongside the testimonial.
In addition to information that you post on your Public Profile Page or other public areas of the Service, which are publicly viewable on the Internet by anyone, we may share your personal information with other users of the Service if you give us permission to do so. For example, some flowcharts may give the viewer the ability to fill out their contact information to receive follow-up communication from the author of the flowchart. While it is entirely optional to provide your contact information in a flowchart, if you choose to do so, we will share your contact information and other information about your use of the Service with the author of the flowchart or the author's agents and representatives or any recipients address that the author designates (such as a group email or mailing list). Please note that if the author of a flowchart designates a group email or mailing list, the contact information you choose to share with the author may be viewable by others. In that event, we may not be able to undo the sharing.
In addition, please note that any messages you send to or receive from other users using the Service are only private to the extent that both you and the person you are communicating with keep them private. For example, if you send a message to another user, that user may choose to publicly post it. Also, we may access and disclose such messages in the course of investigations relating to use of the Service.
As we develop our business, we may buy or sell assets or business offerings. Customer, email, and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer or assign your personal information in the course of corporate divestitures, mergers, or dissolution.
We may disclose your personal information if required to do so by law or subpoena, or if we believe that disclosure is reasonably necessary to: (i) comply with a law, regulation, or legal request; (ii) protect the safety of any person; (iii) prevent fraud, security, or technical issues; or (iv) protect or enforce our rights.
We may use aggregated, non-personally identifiable information for any purpose, including for research and marketing purposes.
Our servers and offices are located in the United States, so your information may be transferred to, stored, or processed in the United States. While the data protection, privacy, and other laws of the United States might not be as comprehensive as those in your country, we take many steps to protect your privacy .
With respect to Personal Information received or transferred pursuant to the Privacy Shield Frameworks, DeciZone is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements. JAMS is the US-based independent organization responsible for reviewing and resolving complaints about our Privacy Shield compliance – free of charge to you. We ask that you first submit any such complaints directly to us at TermsAndPrivacy@DeciZone.com. If you are not satisfied with our response, please contact JAMS at www.jamsadr.com/eu-us-privacy-shield. In the event that your concern still is not addressed by JAMS, you may be entitled to a binding arbitration under Privacy Shield and its principles. Within the scope of our authorization to do so, and in accordance with our commitments under the Privacy Shield, DeciZone will provide individuals access to Personal Data about them. DeciZone also will take reasonable steps to enable individuals to correct, amend, or delete Personal Data that is demonstrated to be inaccurate.
DeciZone is responsible for the processing of Personal Data it receives, under the Privacy Shield Framework, and subsequently transfers to service providers. DeciZone complies with the Privacy Shield Principles for all onward transfers of Personal Data from the European Union, United Kingdom and Switzerland, including the onward transfer liability provisions.
This section applies if you are an individual in the European Union, United Kingdom and Switzerland.
DeciZone is the data controller for processing of your Personal Data. We act as a data processor (or service provider) in relation to the Services we provide to our Customers. Our contact information is available below.
Your Rights : Subject to EU data protection law, you have the following rights in relation to your Personal Data :
if you are an individual in the European Union, United Kingdom and Switzerland, this DeciZone Data Processing Addendum ("DPA") is incorporated into, and is subject to the Terms of Service, the Agreement between DeciZone Inc. and the party identified as the customer of the Service (or "you") in the Agreement ("Customer").
We use commercially available physical, managerial, and technical safeguards to maintain the security, integrity and confidentiality of your Personal Data, and in particular to prevent it from being altered or damaged and to prevent any unauthorized third party from accessing it. For example, we use Secure Socket Layer (SSL) encryption to securely transfer your personal information. However, no website or Internet transmission is completely secure. We urge you to take steps to keep your personal information safe, such as choosing a strong password and keeping it private, as well as logging out of your user account, and closing your web browser when finished using the DeciZone Platform on a shared or unsecured device.
DeciZone may retain your Personal Data for a period of time consistent with the original purpose of collection. For instance, we may retain your Personal Data during the time you have an account to use our Websites or Services, or as agreed in our subscription agreements, and for a reasonable period of time thereafter. We also may retain your Personal Data as necessary to comply with our legal obligations, to establish proof of a right or a contract, resolve disputes, enforce our agreements, in accordance with the law.
DeciZone periodically replicates data for purposes of archival, backup and audit logs.
When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible. We use Amazon Web Services (AWS) to store some of the information that is backed up, such as database information application usage and attachment files.
You can delete your account along with your personal information right from your account preferences.
You can change whether others can view your Content by modifying the settings of the Content to private via the Service. You can also Delete your Content if you wish. However, please note that changing the settings of your Content or deleting your Content or DeciZone account may not remove from public view Content that has been made public before or re-posted elsewhere on the Internet. Once deleted it may not be restored by us, even if you change your mind.
If you choose to Deactivate Your Account, then 1) you will no longer receive any Content related communications from DeciZone, 2) you may still receive account related communication as deemed necessary by DeciZone, 3) users will not be able to interact with you, 4) your Content may remain accessible on the DeciZone Platform. You can reactivate your account by logging in to your account.
Although we may allow you to adjust your privacy settings to limit access to certain Personal Data, please be aware that no security measures are perfect or impenetrable. We are not responsible for circumvention of any privacy settings or security measures on the Service. Additionally, we cannot control the actions of other users with whom you may choose to share your information. Further, even after information posted on the Service is removed, caching and archiving services may have saved that information, and other users or third parties may have copied or stored the information available on the Service. We cannot and do not guarantee that information you post on or transmit to the Service will not be viewed by unauthorized persons.
Protecting the privacy of young children is especially important. Our Service is not directed to children under the age of 18, and we do not knowingly collect Personal Data from children under the age of 18 without obtaining parental consent. If you are under 18 years of age, then please do not use or access the Service at any time or in any manner. If we learn that Personal Data has been collected on the Service from persons under 18 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 18 years of age has obtained an Account on the Service, then you may alert us at TermsAndPrivacy@DeciZone.com and request that we delete that child’s Personal Data from our systems.
The California Consumer Privacy Act (“CCPA”) provides consumers with specific rights regarding their Personal Information. You have the right to request that businesses subject to the CCPA (which may include our customers with whom you have a relationship) disclose certain information to you about their collection and use of your Personal Information over the past 12 months. In addition, you have the right to ask such businesses to delete Personal Information collected from you, subject to certain exceptions. If the business sells Personal Information, you have a right to opt-out of that sale. Finally, a business cannot discriminate against you for exercising a CCPA right.
When offering services to its Members, DeciZone acts as a “service provider” under the CCPA and our receipt and collection of any consumer Personal Information is completed on behalf of our Members in order for us to provide the Service. Please direct any requests for access or deletion of your Personal Information under the CCPA to the Member with whom you have a direct relationship.
Consistent with California law, if you choose to exercise your applicable CCPA rights, we won’t charge you different prices or provide you a different quality of services. If we ever offer a financial incentive or product enhancement that is contingent upon you providing your Personal Information, we will not do so unless the benefits to you are reasonably related to the value of the Personal Information that you provide to us.
